Terms and Conditions of Services

Thank you for considering our services for your event. Please read the following terms and conditions carefully before booking our services.

 

1. Booking and Payment:

a. To secure our services for your event, a non-refundable booking fee of 50% of the total amount is required at the time of booking.

b. The remaining balance must be paid 5 days before the event.

c. If the full payment is not received by the due date, we reserve the right to cancel the booking and retain the booking fee.

d. Our services include charges for overtime, billed in 30-minute increments, with payment due within 48 hours of the event's conclusion.

e. Any delay in payments will add to delivery timeframe. Editing will NOT commence until the payment has been received in full. 

 

2. Cancellation:

a. If you need to cancel your booking, you must notify us in writing as soon as possible.

b. If you cancel 24 hours before the event, you will be liable to pay the full amount.

c. If you cancel 48 hours before the event, you will be liable to pay 25% of the remaining balance.

 

3. Photography/Videography:

a. We will arrive at the event location at the agreed time and begin to set up our equipment before we start shooting.

b. We will use our professional judgment and experience to capture the best possible images, but we cannot guarantee any specific shots or poses.

c. We reserve the right to use our images for marketing and promotional purposes.

d. We are NOT responsible for any interference from guests or other vendors that may hinder our ability to capture the desired shots.

e. We reserve the right to stop shooting if our equipment is at risk of damage due to any reason.

 

4. Editing and Delivery:

a. All images and videos will be edited and retouched by us to our professional standards.

b. We will deliver the final edited images and videos within 4 - 6 weeks after the event.

c. Any extra editing requests must be conveyed before booking in writing to be invoiced accordingly, or after booking for extra charges.

c. We will provide a link to an online gallery where the images and videos can be downloaded.

 

5. Liability:

a. We will NOT be liable for any loss or damage of equipment, images, or video footage.

b. We will NOT be liable for any injuries or damages caused to any person or property during the event.

c. We will NOT be liable for any consequential loss, damage, or expense suffered or incurred by you.

 

6. Force Majeure:

a. We shall not be liable for any failure or delay in performing our obligations due to any cause beyond our reasonable control.

b. This includes, but is not limited to, natural disasters, war, civil unrest, strikes, and government restrictions.

 

7. Consent:

a. By booking our services, you consent to these terms and conditions.

b. You consent to the use of the images and videos captured by us for marketing and promotional purposes.

c. If you do not wish for the images or videos to be used for marketing and promotional purposes, you must inform us in writing before the event, subject to loss of opportunity fee.

8. Loss of Opportunity Fee / Image Non-Usage Fee 

a. In the event that the client requests not to use the images for promotional and marketing purposes, the client shall be responsible for paying an opportunity loss fee or image non-usage fee. This fee is designed to compensate the photographer for the lost opportunity, time, resources, and potential income associated with reserving or holding the images exclusively for the client, while restricting their usage.

b. The opportunity loss fee or image non-usage fee shall amount to 15% of the agreed-upon shoot fee, or $75, whichever amount is lower. This fee is considered a fair and reasonable estimate of the damages incurred by the photographer due to the client's request for non-usage, considering the potential promotional and marketing value that the images could have provided.

c. The opportunity loss fee or image non-usage fee for client's request for non-usage shall be payable at the time of payment if notified before booking or within 48 hours if notified after the session. Failure to remit the fee within the specified timeframe may result in additional charges, including but not limited to late payment penalties or legal expenses incurred to recover the outstanding amount.
